DNP is not licensed as a food, supplement, or medicine in the two jurisdictions the attached records document — the United Kingdom and the United States; the UK Food Standards Agency’s 2003 warning describes it as “not suitable for human consumption” at any level, and the U.S. FDA’s 1938 declaration (“extremely dangerous and not fit for human consumption”) ended its medicinal use, and the ATSDR’s 2019 federal profile recorded that DNP’s medicinal use had been discontinued and that it was ‘still marketed for weight loss by unregulated internet sources.’ Framing it as a fitness-supplement-store product, as Rebelo did by falsely presenting his operation as affiliated with a legitimate retailer and disguising shipments under names like “Optimum Gold,” misrepresents an unlicensed industrial chemical as a regulated consumer good.
